Understanding NIL Law

Since the NCAA's interim NIL policy was introduced in July 2021, college athletes can profit from their name, image, and likeness. However, the House v. NCAA settlement (effective July 1, 2025) introduced the College Sports Commission and the NIL Go clearinghouse, managed by Deloitte, to review third-party NIL deals valued at $600 or more. Deals must reflect fair market value and serve a legitimate business purpose, or they may be denied. Learn more about the settlement.

Denials can occur if deals are deemed "pay-for-play" or involve boosters circumventing revenue-sharing caps. Athletes have the right to appeal denials through arbitration, but the process is complex. Our legal team helps you challenge unfair denials, ensuring compliance with state laws, NCAA rules, and Title IX requirements.

Key regulations include:

  • Deals must be disclosed within 30 days to avoid penalties.
  • Contracts cannot conflict with team agreements or institutional policies.
  • Some states prohibit endorsements of alcohol, tobacco, or gambling products.

We stay updated on the evolving NIL landscape, including state-specific laws and federal proposals, to protect your rights. Read the NCAA's NIL policy.
