Capstone Studios BitTorrent Copyright Lawsuits: What Internet Subscribers Need to Know About These New Federal Cases

If you have received a subpoena notice from your internet service provider (ISP), a settlement demand, or a federal copyright complaint filed by Capstone Studios Corp., you are not alone. Capstone has emerged as another copyright owner actively pursuing alleged BitTorrent infringement claims in federal court. Like Malibu Media before it and Strike 3 Holdings more recently, Capstone is using forensic software to identify IP addresses allegedly involved in sharing copyrighted motion pictures through the BitTorrent protocol.

This article examines three recent Capstone lawsuits, discusses the company's overall litigation strategy, and explains what subscribers should know if they become the target of one of these cases.

The Recent Capstone Studios Cases

1. Capstone Studios Corp. v. Does 1-7

Case No. 1:25-cv-03564 (D. Colo.)

Film at Issue: Silent Night

This lawsuit was filed in the United States District Court for the District of Colorado against seven anonymous "Doe" defendants identified only by IP address.

Like many BitTorrent cases, Capstone filed:

a copyright infringement complaint;
claims involving alleged DMCA violations;
a motion seeking expedited discovery before the Rule 26(f) conference; and
a request to subpoena the internet service providers to identify the subscribers behind the IP addresses.

The Court Did Not Grant Everything Requested

Magistrate Judge Cyrus Y. Chung took a measured approach.

Rather than allowing subpoenas for every listed defendant, the court limited early discovery after examining whether the defendants had been properly joined in a single lawsuit. The court concluded that only one defendant could proceed at that stage, substantially limiting Capstone's requested discovery. This illustrates that at least some federal courts are carefully scrutinizing mass BitTorrent lawsuits rather than automatically approving broad subpoenas.

2. Capstone Studios Corp. v. Does 1-6

Case No. 1:25-cv-03561 (D. Colo.)

Film at Issue: Breathe

Filed the same day as the Silent Night action, this companion case followed an almost identical procedural path.

Capstone again sued multiple anonymous defendants identified only by IP address and requested permission to issue early subpoenas to ISPs.

The Colorado court again exercised caution. Later in the litigation, Capstone even filed a second motion seeking additional expedited discovery, which the court denied without prejudice.

These rulings suggest that Colorado courts are not simply rubber-stamping requests for mass discovery in BitTorrent litigation.

3. Capstone Studios Corp. v. John Doe (73.95.253.148)

Case No. 1:26-cv-00541 (D. Colo.)

Film at Issue: Silent Night

Unlike the earlier multi-defendant lawsuits, this case targets only a single subscriber assigned one IP address.

Because joinder concerns were eliminated, the court granted Capstone's request for expedited discovery much more readily, allowing the plaintiff to subpoena the ISP to obtain subscriber identifying information.

This shift may indicate a strategic change toward filing individual actions when courts become skeptical of multi-defendant BitTorrent complaints.

Who Is Capstone Studios?

Capstone Studios Corp. is a motion picture production and distribution company that has increasingly turned to copyright litigation to protect its films from unauthorized BitTorrent distribution.

The cases are generally prosecuted by attorney Kerry Steven Culpepper, who has represented numerous copyright holders in BitTorrent enforcement litigation across the country. Recent Capstone lawsuits have appeared in jurisdictions including:

District of Colorado
District of Hawaii

Recent filings also include both individual and multi-defendant actions in Hawaii, showing that the company's enforcement campaign extends beyond Colorado.

How Many Cases Has Capstone Filed?

Capstone appears to be engaged in an active nationwide copyright enforcement program.

Publicly available federal dockets show numerous cases filed during 2025 and 2026, including:

individual subscriber lawsuits;
multi-defendant Doe actions;
expedited discovery proceedings; and
cases involving multiple copyrighted films.

The number of filings continues to grow as new cases are filed in multiple federal districts. Public docket records show an expanding enforcement campaign rather than isolated litigation.

What Is Capstone Alleging?

Like many BitTorrent copyright plaintiffs, Capstone generally alleges that:

defendants downloaded copyrighted films;
BitTorrent automatically redistributed portions of those films to other users;
each upload constituted unauthorized distribution;
forensic investigators monitored BitTorrent swarms;
IP addresses were captured;
geolocation data identified the appropriate judicial district;
ISPs can identify the subscriber associated with each IP address.

Many complaints also include allegations under the Digital Millennium Copyright Act (DMCA).

Does an IP Address Prove Who Downloaded the Movie?

No.

One of the biggest misconceptions in these lawsuits is that identifying an IP address identifies the infringer.

It does not.

An internet account may be used by:

spouses;
roommates;
children;
guests;
employees;
tenants;
neighbors using unsecured Wi-Fi;
other unknown users.

Federal courts have repeatedly recognized that an IP address identifies only the subscriber account—not necessarily the individual who committed the alleged infringement.

That distinction can become critically important during litigation.

How Do These Cases Usually Resolve?

Many BitTorrent copyright cases resolve before trial.

Common outcomes include:

confidential settlements;
voluntary dismissals;
dismissal after investigation reveals evidentiary issues;
default judgments when defendants ignore the lawsuit;
negotiated payment plans.

Public dockets also show instances where Capstone voluntarily dismissed certain defendants after obtaining subscriber information or after further investigation.

Because most settlements remain confidential, the precise settlement amounts are generally unavailable.

Possible Defenses

Generally, no.
