Will a Motion to Quash the Subpoena Help?

The materials you received in the Notice from your ISP of a subpoena being sought includes a right to challenge the release of information such as your name and your address.  The letter may inform you that you have a certain deadline to seek a “Motion to Quash the Subpoena” or to seek a “protective order.”

VIDEO:  These are two options that might be available in your case.  Call us to discuss these . Or click on the picture above to watch Attorney Steve® explain the Motion to Quash.  Make sure to SUBSCRIBE to our legal channel

What is a Protective Order?

A protective Order is either a Motion you file with the Court, (or sometimes the other party will agree and “stipulate” to a protective order).  In the context of illegal internet movie downloading, the protective order would be filed if needed to protect the Defendants name and address (the John Doe Defendant), from being made publicly known.  When this happens, the potential for a “shame settlement” (whether a defendant is guilty or not) becomes greater.  So it is always best to seek a protective order if you need it.

Why you should hire a California Law Firm if you are sued in California?

We are one of the few Torrent Defense law firms located in the state of California.  We have offices in Santa Monica (covering the Los Angeles region) and in San Diego (covering La Jolla, Del Mar, Carlsbad and Oceanside areas) and another office in San Francisco (covering San Jose, the Bay Area, Silicon Valley and East Bay area.  We also have an office in Phoenix, Arizona (covering Scottsdale, Phoenix, Tempe, and other areas in Maricopa County) and an office in Newport Beach (covering Laguna Beach, Huntington, Dana Point, Costa Mesa and Orange County).

If you are sued in California and the opposing counsel seeks your defense counsel is from, let's say Texas, or Florida, or New Jersey, they may tend to get a little more aggressive than they would normally be in seeking an higher settlement amount simply because they know your counsel may not be willing to FLY IN, PAY TRAVEL COSTS and LITIGATE THE CASE.  Before you hire a Strike 3 defense attorney, ask them this.

We can handle cases in the Southern District of California, the Central District, the Eastern District and the Northern District.
