November 2021 BitTorrent Litigation Update:  Strike 3 continues to fire off copyright infringement lawsuits in all 4 districts of California including the Southern, Eastern, Central and many in the Northern District of California (where many IT professionals, software engineers and other technology workers are located).  This is done through their geo-location technology that helps them pinpoint where the potential "John Doe" defendants are located, and even though many are located in California bay area, Strike 3 often starts their pursuit of online infringers in a "Bill of Discovery" in Miami-Dade County in Florida.  Even if those cases result in the subpoena being "quashed" we have noted that many California residents will continue to be pursued in California federal district courts up and down the state.  In California, there is no other firm that has represented more clients as the image below shows.  In we have recently been identified by Unicourt as the top copyright infringement defense firm nationwide, that has handled copyright infringement defense cases, per number of cases.

Remember, in the 9th Circuit (ex. Arizona, California, Washington, Utah, Montana, Oregon) the "Cobbler case" applies.  This means, Strike 3 Holdings, LLC cannot proceed with a federal court lawsuit JUST BECAUSE you are the named subscriber to an internet account (ex. a Cox or Comcast subscriber).  They are required to show "additional evidence" that at least raises an inference that the SUBSCRIBER is also the INFRINGER.  If they cannot do this, a motion to dismiss the lawsuit may be proper, and in fact, lawsuits have been ostensibly dismissed for this very reason.

Interestingly, we just had a competitor from Chicago try to obtain one of our domain names in a WIPO domain dispute (but failed miserably).  You should factor this in when deciding your choice of copyright counsel.
