Remember, in the 9th Circuit (ex. Arizona, California, Washington, Utah, Montana, Oregon) the "Cobbler case" applies. This means, Strike 3 Holdings, LLC cannot proceed with a federal court lawsuit JUST BECAUSE you are the named subscriber to an internet account (ex. a Cox or Comcast subscriber). They are required to show "additional evidence" that at least raises an inference that the SUBSCRIBER is also the INFRINGER. If they cannot do this, a motion to dismiss the lawsuit may be proper, and in fact, lawsuits have been ostensibly dismissed for this very reason.
Interestingly, we just had a competitor from Chicago try to obtain one of our domain names in a WIPO domain dispute (but failed miserably). You should factor this in when deciding your choice of copyright counsel.
