We are seeking an experienced, credentialed, and well-rounded "Digital IP Paralegal." Responsibilities & Duties
A. Copyright Law
- Prepare copyright applications and respond to the Copyright Office examiners' inquiries.
- Help clients establish a DMCA-designated agent.
- Assist with copyright licensing projects and case.
- Assist Attorney in copyright litigation cases (e.g. preparing pleadings, engaging in legal research, preparing memorandums of law, etc.).
- Draft work-for-hire agreements.
- Draft copyright assignments.
- Communicate with clients to ensure needs and requirements are met.
- Work on BitTorrent file-sharing litigation such as experience with Strike 3 Holdings, LLC
- Assist attorney in handling art and photo infringement cases
B. Trademark Law
- Prepare trademark applications and respond to the USPTO examiners' inquiries.
- Work with clients to obtain necessary specimens.
- Assist in responding to USPTO office action letters.
- Work with the attorney on trademark cancellation and opposition proceedings.
- Help clients protect their brand by registering their trademarks with various entities such as trademark clearinghouse.
- Research and prepare cease and desist letters and DMCA takedown notifications.
- Assist attorney with DMCA counter-notification cases.
- Assist lawyer with trademark arbitration, litigation, and mediation (pleadings, research, etc.).
- Assist attorney with drafting and responding to UDRP domain disputes.
- Understanding and experience working with Counterfeit product cases.
C. Piracy Law
- Assist Attorney with handling a wide variety of infringement and anti-piracy cases.
- Work with clients to obtain information as needed.
- Understanding of Reverse Domain Name Hijacking (RDNH).
- Familiarity with IPTV defense (MPAA, ACE Alliance, Dish-Nagrastar).
- Assist in preparing draft letters, pleadings, and responses.
D. Content Creator & Influencer Law
- Assist attorney with handling right of publicity cases.
- Legal research involving right of publicity and celebrity influencer law.
- Help draft, prepare, and review advertising and social media influencer agreements.
- Prepare name, image, and likeness agreements (N.I.L).
- Assist in preparing draft letters, pleadings, and responses.
E. Social Media Marketing Guru
- Help coordinate with Vondran Legal® comprehensive social media marketing efforts.
- Assist with Facebook, Twitter, YouTube, LinkedIn, TikTok and other social media initiatives.
- Assist with monitoring competitor activities, including legal filings and social media posts.
- We are looking for a creative "ideas person" to spearhead fun and engaging social media content.
- Knowledge and experience using ChatGPT and other artificial intelligence platforms.
Qualifications
- A minimum of 5 years of copyright paralegal experience is required.
- Must be a self-starter, self-motivated, and eager to help build business.
- Must have a "can-do" and "will-do" attitude at all times.
- Must be willing to work overtime as needed.
- Must have strong legal research ability (e.g. Westlaw, Nexus).
- Ability to review Federal court dockets and pull relevant documents.
- Specific demonstrable experience working with the United States Copyright Office and USPTO.
- Experience preparing complicated copyright (eCO) and trademark applications.
- Must be able to demonstrate skill in conducting copyright searches through the Copyright Office's online public records search.
- Familiarity with the Compendium of U.S. Copyright Office Practices.
- A strong understanding of the Digital Millennium Copyright Act (“DMCA”).
- A bachelor's degree and/or paralegal certificate from an ABA-accredited program is required.
- Must have detailed and extensive litigation experience, including legal research, preparing and responding to pleadings, etc.).
- Organizational skills and time management skills are a must.
- Leadership skills involving taking initiative, exercising strong judgment, and prioritizing workflow are a must.
- Strong communication and interpersonal skills are required.
- Ability to thrive under pressure and meet deadlines.
- Must have a love and passion for social media marketing.
- A bachelor's degree and/or paralegal certificate from an ABA-approved paralegal program is required.
