Introduction

The world of pirating video footage seems to grow each day.  Our firm represents many major YouTubers and their channels, and sometimes this means responding to DMCA copyright strikes, filing counter-notifications, or engaging in federal court litigation.  Their are many companies out there who seek to enforce IP legal rights, a few such companies include:

What to do when you receive the "love letter"

The first thing to do when you receive a demand letter is to NOT immediately reach out to them or their representatives to protest your case.  The first step is to call legal counsel.  I am not trying to force you into retaining a law firm, but I have seen some real damage done by business or channel owners reaching out, admitting fault and liability, and potentially getting into a heated debate over settlement fees.  This is NOT the way to handle your case.  You may also want to consider immediately taking down the content at issue, accused of being pirated, unless you believe you have a strong case for a defense, such as (a) you have a paid license, (b) the content is in the public domain, or (c) you have a fair use right under 17 U.S.C. 107 (watch my video here).
